Arrow Dynamics, LLC, a North Carolina limited liability company with a principal office address at 14481 Lochridge Boulevard, Covington, Georgia 30014 (“Arrow”), and FL Outdoors, LLC, a Georgia limited liability company with a principal office address at 14481 Lochridge Boulevard, Covington, Georgia 30014 (“FL Outdoors”), are jointly holding a contest in which they will give away a hunting trip with Levi Morgan and Joel Burham to one (1) lucky winner (the “Giveaway”). Arrow and FL Outdoors are collectively referred to herein as the “Sponsor.”

All Entrants (as defined in Section 1(b) herein) are subject to these Official Rules (these “Official Rules”).

1. Eligibility and How to Enter.

  a. Eligibility. The Giveaway is open to all persons eighteen (18) years of age and over who are United States residents. Members, managers, employees, and agents of Sponsor as well as their immediate family (i.e., spouse, parents, siblings, and children) are not eligible.                   

  b. How to Enter:

        I.  The Giveaway is being hosted through a sweepstakes tool known as Viral Sweeps and will take place beginning on, and including, 12:01 a.m. E.S.T. on August 1, 2024, and ending on, and including, 11:59 p.m. E.S.T. on August 25, 2024 (the “Contest Period”).   

      II. During the Contest Period, eligible persons (each, an “Entrant”) can receive one (1) entry into the Giveaway by visiting floutdoors.com/summer-sweepstakes, accepting the rules for the Giveaway, and submitting their contact information (including but not necessarily limited to their name and email address1). Multiple Entrants are not permitted to share the same email address. Only one (1) entry per Entrant can be submitted in this manner.                            

     III. After submitting an entry in accordance with Section 1(b)(ii) above, an Entrant may obtain additional entries during the Contest Period by doing any of the following: 

          1. Thirty (30) additional entries for completing the survey concerning Entrant’s demographic information, shopping preferences, and media consumption preferences located at https://app.viralsweep.com/sweeps/full/888534-159010?framed=1&tpid=159010&tptime=1715021515&tphash=ce959c0811; and,

          2. Two (2) additional entries for sharing official posts about the Giveaway on social media (i.e., Facebook, Instagram, etc.)  

      IV. Once submitted by an Entrant, an entry becomes the property of Sponsor and will not be acknowledged by Sponsor or returned to Entrant.   

      V. Any attempt by an Entrant to obtain more than the stated number of entries by using multiple identities and email addresses or any other methods will void that Entrant’s entry, and that Entrant will be disqualified.

      VI. Void where prohibited   

  c. No Purchase Necessary. No purchase is necessary for an Entrant to enter the Giveaway or win the Prize. A purchase does not enhance an Entrant’s chance of winning.

  d. Disqualification. Sponsor, in its sole discretion, reserves the right to disqualify fraudulent entries, entries suspected of being fraudulent or false, and any illegible, defective, incomplete, or physically-altered entries. Sponsor is not responsible for any errors on the entry forms or for any failure by Sponsor to receive any entries prior to the deadline set forth herein.

  e. CAUTION: Any attempt by an Entrant to obtain more than the stated number of entries by using multiple identities and email addresses or any other methods will void that Entrant’s entry, and that Entrant will be disqualified.                                

2. Odds. The odds of winning the Giveaway depend upon the number of eligible entries timely received by Sponsor.

3. Drawing and Prize.

  a. Drawing. There will only be one (1) drawing (the “Drawing”), and one (1) winner (the “Winner”) will be randomly selected among all eligible Entrants at the Drawing by the Sponsor representative (the “Representative”) who conducts the Giveaway as described herein. The Drawing will be held on or about August 28, 2024. The selection of the Winner by the Representative shall be final and binding.

  b. Prize. The Winner will receive a prize (the “Prize”) consisting of a hunting trip package. Specifically, the Winner will have the opportunity to attend a hunting trip at Cactus Jack Ranch, Texas from November 30, 2024 until December 5, 2024 with Levi Morgan and Joel Burham. The Prize includes, an allowance of Five Hundred Dollars ($500.00) toward airfare as well as all of the following during the applicable time period: transportation to/from the airport to/from Cactus Jack Ranch, lodging, meals, shooting lessons, hunting license, and hunt to try to shoot a 155-inch B&C Class buck. If the Winner is unable to attend the hunting trip during the above- stated time, the Prize will be forfeited. The Prize is subject to availability. All expenses and incidental travel costs not expressly stated in the prize description above, including but not limited to, other ground transportation, airfare, telecommunication charges, security fees, taxes, or other expenses or incidentals are the responsibility solely of the Winner.  

  c. Prize Value. The Prize has a retail value of up to Eight Thousand Dollars ($8,000.00), exclusive of taxes, gratuities, and other charges which will be the sole responsibility of the Winner.

  d. Prize Restrictions. The Prize cannot be substituted, assigned, transferred, or redeemed for cash by the Winner; however, Sponsor reserves the right to make substitutions of the Prize or prize components with another of comparable or greater value at its sole discretion.    

  e.  Disclaimer. Sponsor does not assume any liability whatsoever related to the Prize, including any tax or other issues associated with acceptance or use of the Prize. Sponsor is not responsible for any tax implications of the acceptance of the Prize and makes no representation regarding the tax implications of accepting the Prize.   

4. Notification of Winner. The Winner will be notified via phone, United States Mail, and/or email using the information provided by the Winner on his or her entry. If the Winner cannot be located or fails to return Sponsor’s attempts to contact him or her by 5:00 p.m. on the third (3rd) business day following the Drawing, such Winner will be deemed to have forfeited the Prize, and, at Sponsor’s discretion, another Winner may be randomly selected from among the eligible Entrants.    

5.  Receipt of Prize. To be eligible to receive the Prize, the Winner must provide all information requested by Sponsor, including but not limited to, proof of age and proof of identity. Additionally, the Winner may be required to complete and return a release concerning eligibility, liability, and publicity (the “Release”). The Prize shall be forfeited by the Winner if he or she (a) cannot be notified, as stated herein; (b) fails to execute any Release required by Sponsor; or, (c) cannot accept or receive the Prize for any reason.

6.  Applicable Taxes. The Winner will be subject to applicable federal and state income taxes and other taxes payable due to his or her acceptance of the Prize and the law, regulations, procedures, rules, and directives applicable to drawings. The Winner will be issued an IRS Form 1099 for the value of the Prize. Sponsor makes no guarantee that the IRS will accept the value of the Prize for the purpose of determining any income tax that may be due from the Winner. The Winner may be asked to provide a Form W-9 and should consult a tax advisor regarding applicable taxes.   

7. Right to Use Name and Likeness.

  a. As to Entrants. By entering the Giveaway, an Entrant grants Sponsor the right to use and print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time his or her name in connection with the Giveaway (but not as an endorsement of any business or services) without payment or additional consideration, and without review, approval or notification.

  b. As to Winner. Further, by accepting the Prize, the Winner grants to Sponsor and those acting pursuant to the authority of Sponsor the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time the Winner’s full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without Winner’s review, approval or notification.

8. Disputes. By entering the Giveaway, Entrants agree to the following:

  a.  Any and all disputes, claims, and causes of action arising out of or connected with the Giveaway or the Prize shall be resolved individually, without resort to any form of class action;

  b. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Giveaway but in no event attorney’s fees; and,

  c. Under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim, punitive, incidental or consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

9. Limitation of Liability. BY ENTERING, EACH ENTRANT FOREVER DISCHARGES AND RELEASES SPONSOR, ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, SHAREHOLDERS, MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS FROM ANY AND ALL LIABILITY, CLAIMS, CAUSES OF ACTION, SUITS, AND DEMANDS OF ANY KIND ARISING FROM OR IN CONNECTION WITH THE GIVEAWAY, INCLUDING, WITHOUT LIMITATION, (A) ANY TECHNICAL ERRORS THAT MAY PREVENT AN ENTRANT FROM SUBMITTING AN ENTRY; (B) UNAUTHORIZED HUMAN INTERVENTION IN THE GIVEAWAY; (C) PRINTING ERRORS; (D) LOST, LATE, MISDIRECTED, OR UNDELIVERABLE ENTRIES; (E) ERRORS IN THE ADMINISTRATION OF THE GIVEAWAY OR THE PROCESSING OF ENTRIES; OR, (F) INJURY, DEATH, OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM ENTRANT’S PARTICIPATION IN THE GIVEAWAY OR USE OR RECEIPT OF THE PRIZE, HOWEVER CAUSED.

10. Termination of Giveaway. Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Giveaway if anything required for its conduct should malfunction or be deemed illegal.

11. Distribution of Official Rules. A copy of these Official Rules shall be made available to each Entrant prior to the time that he or she completes his or her entry.

12. Entrant’s Agreement. By entering, each Entrant unconditionally agrees to and accepts the terms of these Official Rules and by the decisions Sponsor makes regarding this Giveaway, which are final and binding on all matters. Winning the Prize is contingent upon fulfilling all requirements set forth herein.

13. Miscellaneous.

   a. Governing Law. The validity and interpretation of these Official Rules and terms of the Giveaway shall be governed by and construed under the laws of the State of Georgia, without regard to its principles of conflicts of law.

  b. Venue. All disputes resulting in legal action shall be resolved in the state or federal courts having jurisdiction over Bibb County, Georgia, and Entrant consents to the exclusive jurisdiction of those courts.

  c. Severability. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

  d. Modification. These Official Rules can only be modified by a writing signed by a duly-authorized representative of Sponsor.
